It is possible to get console banned on your first offense, but it all depends on what you did.

Why did you get banned? You may have deserved it but it may be on your accounts cloud.

Pretty sure there is no way.

Im sure the enforcement team will tell you the same thing but, when you create an Xbox Live account you agree to abide by the T.O.S, and im sure there is a clause in the T.O.S that says when this happens, the player, aka you, will not be able to recover the funds or the digital content

If you actually got banned for that, then sure, but if you get multiple warnings from Microsoft or whatever and still get banned and wonder why they won't give you your stuff back, then there is your answer. My account in 2012 got banned because I was being an idiot and going into modded lobbies, etc, and I can say I never deserved to get my stuff back because when you make an account, IIRC, you agree to their terms. I wish I would have gotten my stuff back but completely understand why they don't give people that option back.

Think it was because I ISO modded WAW, I went back on it like 3 years after ISO modding it to see what it was like and then few days later bam haha

I agree, you shouldn't lose EVERYTHING for talking smack, but it could all be avoided but not being vulgar and being civil while chatting, but we all know that'll never happen

What sucks though is that it's 2017 and everyone is offended and triggered by small stuff so somethig is always offensive to someone.

I agree, being banned for "shit talking" is ridiculous.

It's also scandalous how they stop you playing games that you paid for. Out of order if you ask me

Once your account is banned, then that's it I'm afraid, don't think there is any way to get your games back.
