[align=center] 13-year-old California boy carrying a replica of an assault rifle to a friend's house was shot dead by a sheriff's deputy who believed the gun was real, authorities have said.

The incident took place in Santa Rosa, northern California, on Tuesday, a day after a 12-year-old boy killed a teacher at a Nevada middle school with a gun he then used to take his own life.

The Santa Rosa boy's father said his son, Andy Lopez Cruz, a middle schooler who played the saxophone and liked basketball and boxing, was shot while on his way to a friend's house with a pellet gun that had been left at the family home over the weekend.

"It's not right what they did to my son," said the father, Rodrigo Lopez, as he sat with friends and family on Wednesday outside Santa Rosa City Hall in a quiet protest.

Lieutenant Paul Henry, who is investigating the incident for the Santa Rosa police department, said two Sonoma county sheriff's deputies had been patrolling a street near the boy's home on Tuesday when they saw him walking with what appeared to be an assault weapon in his left hand. The Kid was warned to put the weapon down twice.

It's a terrible accident, but people need to know a gun is a gun, whether it shoots 9mm or plastic BBs. And there are chances where they are mistaken for a real gun. I'm sure there is more to this story though. The cop should have to the kid to put down the rifle, which i'm sure the cop did say that.

Such a horrible accident. The sheriff should of at least said put the gun down and make sure it wasn't real.

Well that's not the point. There are $3k+ airsoft guns you can purchase online that are made out of all metal. They look exactly like the real thing. The cops job is to protect people, and the cop didn't know whether it was real or not. I can bet the cop did not want to hurt the kid. But the kid did not listen to the cops commands.

According to the police he said it twice.
That doesn't mean he actually said it.

I completely agree with what you are saying cops have it alot worse than people think, Wouldnt you be scared if you didnt know if it was a real gun or not
