DFU mode isn't doing anything since I can't turn off the ipod..
also and mikeyman14, it's jailbroken.

did you clean out your TEMP folder if so... there is your problem
try to go through recycle bin like a mad man to try to find it
this did happen to me once
what i did was put it on never sleep mode and let the battery die... IT WORKED

Nooo its WAY easier to just re-jailbreak it, thats what I do with mine

Hold the Bottom button and the top button at the same time for 10 seconds and It will restart it should work then.
