PlayStation Network hacking lawsuit largely dismissed

A federal judge has dismissed multiple charges levelled against Sony in a class action lawsuit over last year's PlayStation Network hack and subsequent breach of customers' personal information.

According to Courthouse News, US District Judge Anthony Battaglia dismissed charges including negligence, restitution and unjust enrichment.
He also cleared Sony of violations of California consumer protection laws "because none of the named plaintiffs subscribed to premium PSN services, and thus received the PSN services free of cost."

He went on to dismiss a bailment charge because "plaintiffs freely admit, plaintiffs' personal information was stolen as a result of a criminal intrusion of Sony's Network. Plaintiffs do not allege that Sony was in any way involved with the Data Breach."

Additionally, while Sony is accused of misrepresenting the quality of its protections, Battaglia noted that all PSN users signed a Sony Privacy Policy that included "clear admonitory language that Sony's security was not 'perfect,'" therefore "no reasonable consumer could have been deceived."

Battaglia gave the class the option to amend its claims for injunctive relief and violation of consumer protection law.

XVI They don't want to have a lawsuit every time they get hacked. Otherwise they would have one every 10 minutes. LOL


So true. I don't understand after 1 month of them being shut down they down upgrade there security. One day It is going to go back down and they won't get it back unless they do something now.

Flirty Ok I dont see why they would do that I mean really the month they were down they were earning no money and using more money to get PSN back up why would they just dismiss the lawsuit against them makes no sense I forget the ammount they lossed while the PSN was down it was well over a million dollars


Did you even read the article? The case was against Sony. You're defending Sony (well I think you are it's hard to follow your post) when they don't need to be really.
