Judge: Activision's suit against EA and former IW heads can proceed

A California judge has ruled that the lawsuit filed by Activision against former Infinity Ward studio heads Vince Zampella and Jason West can move forward. EA originally filed to dismiss the case after Activision claimed that its rival colluded with West and Zampella while they were still under contract, but California Superior Court Judge Elihu Berle decided today that there was enough evidence for the case to go on towards trial.

EA can still file a request for a summary judgment, so there's still one more option for the courts to reject Activision's claims of collusion and avoid actually going to trial. If that request isn't filed or the judgment doesn't eventually pass, then the lawsuit itself is set to go to trial in May of this year.

Electronic Arts is definitely going to win the case over Activision, because it is true that Activision has visual and commerce rights over call of duty so does infinity ward. So Respawn Entertainment has full rights of making a call of duty because they created it and most didn't sign the contract that pertained to the rights being given over to Activision.

It's not Infinity Ward,it is Activision and they are right to follow through on the law suit in my opinion.

It was pretty serious thing to happen and a breach of contract,it is their right to pursue legal action to the fullest.

This lawsuit is just messy, who knows what will come out of this! :S

If they actually was smart enough to think about the players of their games, and just get to geather on the game calm and nicely, that would be nice... =D

Your an idiot, you telling him he needs to learn how to read? You cant even understand the first line of the article. Activison is suing Vince Zampella and Jason West, the former heads of Infinity Ward. Jason and Vince are now working with EA as a company called "Respawn Entertainment" thats why EA was trying to get the judges permission to dismiss the case.

Activision, the people that created Black ops are suing Infinity Ward, the people that created Cod 4 and Modern warfare 2. They are suing because Activision and Infinity Ward had a contract to work together, but Infinity Ward back stabbed Activision by helping out a company named West, and Zampella.
