NVidia recently settled a class action lawsuit for the GTX 970. As the GPU was advertised as having "4GB" VRAM, but technically only had 3.5GB of useable VRAM, NVidia have to pay GTX 970 owners. As far as I am aware, there are no details on payment methods as of yet, but you should get around $30.

Aside from this, if you bought your card from Newegg or Amazon, log in to your account now and go speak to customer service. Tell them you're unhappy you bought an item that was falsely advertised and ask for a partial refund. Newegg seem to be offering 10% refunds to anyone who bought a GTX 970, and Amazon are offering 20%. Some people are having issues with this, but I imagine customer services have been bombarded by GTX 970 owners.

I have also seen reports of people asking to just send their GTX 970 back as they're unsatisfied and unhappy that it was falsely advertised and they have received full refunds for their 970.

Hopefully Amazon get back to me soon and give me some monies so I can treat myself to some donuts and a kebab, thanks to my GPU. I wonder if I'll be able to get a 40% refund for buying SLI 970s?

Does this also apply to 970M?

I bought a laptop back then and I am curious if I am affected as well.

I'm actually not sure. I've updated the topic with some sources. The topclassactions post only mentions the desktop GTX 970. I did, however read something about a 970M/980M potentially also being involved? I think if you bought a laptop with a 970M/980M from Amazon or Newegg, you could maybe hit up customer services and bs your way in to some money lol. Assuming you get a not so tech savvy rep.

Otherwise, I'd just keep an eye on the topclassactions post to see if they mention mobile GPUs at any point.

They only miss represented the specs on the desktop 970, the laptop cards still had the correct specs from my knowledge.

This may be a dumb question, but in order to receive the $30 do I have to send back my GTX 970?

No. You may have to provide some sort of proof of purchase though.

Proof that you purchased a GTX 970, like a receipt or something. Maybe a serial number, which would most likely be on your original packaging, and probably a sticker on your card somewhere.
