Yes, but there's always a chance you'll get suspended/banned for marketplace theft, so be careful!

Chances of being banned for modding a gamerpicture is very slim. Unless you put it in your motto/bio/etc... saying "I modded my gamerpicture trololol" I use modded packs all the time never have been banned.

That's very true, but if you ever get caught, Microsoft does NOT take lightly to Marketplace Theft, so I don't know if I would risk it.
