It releases on the 23rd in austrailia and america but if i change my local to austrailia will i get to play it later on as it is already 7:30pm there now

No. It is released in Australia on the 26th actually not the 23rd. 23rd is only for North America

i assure you it is the 23/09/2014. i myself tend to live in australia and have changed my locale to US in order to get it 3 days earlier.

Ahh your right. It is the 25th. So you are still better going on US locale.
I ordered from India local for 27 and now switching to US locale to download early lol.
And there is no way they can console ban you idiot. The feature is there to be used, it is not illegal.

This can be considered a loophole as your are buying the game cheaper than your actual region, so yes there is a chance you can be banned..
