I have an iphone 4s and I cant use it due to its cracked. Can I take it out of the 4s and put it into my old 3gs? They are both AT&T iPhones but I want to see what the risk is?

You will be absolutely fine.

The only issue will be the size of the Sim Card.

Your 4S takes a Micro Sim, the 3GS takes a Standard Size.

You can get adapters but you can also go to your provider and they can change the sim for you.

There are no risks with this as they are both on AT&T

You can get a sim holder which makes it bigger it's like a frame you put your micro sim in to make it bigger. No risks.

As others have said, you are perfectly fine and legal to remove your SIM card and put it into anther device of your choosing.
