I know people were saying that it wasn't a crime, but carrying an assault rifle in a public place can be seen as a suspicious act.

It only takes one stupid person to start unloading bullets into lots of people. I think the police did the right thing in this situation.

I think the police had a right to step in, but not charge him with a crime. They could've approached him and said
"Sir your weapon is alarming everyone, will you please either put it away or calmly leave the mall?'

He wasn't hiding it so it could easily tell that nothing was going to go down ..

But like he said Legally allowed to carry a Fire-arm.

I agree with him being innocent but if I saw someone with a gun like that in public I would for sure be alarmed. He should carry a concealed weapon instead of slinging an Ar over his back.

If he was following the law like the other %95 of law abiding gun owners, then the police obviously had no right to charge him with a crime as that is oppression, but then again most liberals beleive if you own a gun your submitting your self to oppression. But its sad if people get worried when they see a gun. A gun is not going to kill you, it can't. Its impossible. You should be worried about the man hiding or holding the gun, especially if its aimed at you. Guns cant kill people, People kill people. and the founding fathers gave us the second amendment not to protect ourselves from criminals but to protect ourselves from the politicans and leaders of our country, I mean they did just get done fighting the revolution so why else?

I heard something about people near Washington state were carrying around MP5's just to exercise the right when Gun Control was a hot topic.

What I find disturbing is that in order for him to have the charge of "Disorderly Conduct" he would have to fit under the premise of Texas PC 42.01 (8)( [ Register or Signin to view external links. ] , which states "A person commits an
offense if he intentionally or knowingly:...displays a firearm or other deadly weapon in a
public place in a manner calculated to alarm". By just having it "Slung over his back" then he is clearly NOT displaying it in a "manner calculated to alarm", such as pointing it at people while saying "Bang Bang". They are doing this under section 42.01 and 46.01( [ Register or Signin to view external links. ] , which governs weapons (open carry of a long gun is not mentioned in TPC 46.01). I find this alarming. Since it's not a crime to open carry a long gun in the great country of Tejas, what was the PC used to stop, question and ultimately disarm, arrest, charge and jail this individual? I have always been a supporter of LEA's and have trained agencies on skills and trained with agencies in courses, but the pattern of behavior in the past few years have caused me to severely sway my opinion. This type of case is becoming more and more prevalent. There was a case similar near Ft Hood where a guy was walking with his son and had a bad run in with a LEA, that was caught on tape. Please see the video below.


Just listen to what the LEA is saying "I'm going to disarm you to make sure there is no issue". What right does he have to do just that if the guy was not threatening him in any way. There are tons of videos on YouTube right now. Just search "Open carry harassment 2013".


We are falling more and more into a Police State in the US and I find it disheartening. The Police continue to overstep their authority and violate the Constitution while most of the "Sheeple" just sit there and take it.

Now, if any of these guys had used their weapon in a threatening manner and pointed it at people or at the police then I see no problem with them being disarmed, but in most of the cases I have found this not to be the case.

If it's not against the law to open carry, then why do LEA's continue to stop people? We don't need new laws, we just need to enforce the ones we have.
