i just had a chat with someone from xbox support. i asked them if i would receive some sort of penalty if i were to play the game early.

so if you DO get the game EARLY, or manage to find some sort of download of it, you can play it safely without hesitation.

That is true, but if it was a already online ready game, you shouldn't play online.
As they cannot track who has legit copies.
For GTA: V it will be fine.
