They have pads on the side for when it lays down and it's built to stand so I think it's just for whatever space you have

Probably something to do with the hardware. I'm guessing the fan or cooling system. Not too sure though.

It depends what xbox you have I have the xbox 360 slim and I put it vertical as the air vents are on the side and on top of it. but the downside of this is that if I accidentally drop it my disk will get marked by the lazer and wont work

I prefer it laying down because if you have it standing up and it falls your in deep poo.

My disk tray used to do the same thing, the thing that helped mine was to make sure it was on a flat surface
