not really , theres a chance but you rarely see people getting banned for this .

If they somehow caught you, then yes, they could ban you for Marketplace Theft.

But it is pretty unlikely.

No, it's never safe. You're misusing the feature and deserve to be banned if you do it.

And don't come complaining here when you do get banned.
