i never knew you can get banned for that i do it everyday when i play mw2 from my cousin account

Without "license transfer" once he has recovered his account, you may not be able to play the game because it is accessed on his Xbox 360. You may have to License Transfer.

I don't believe you will. Because if you do that, you need his account to play the full version so pretty much you will have the demo. You are %100 safe.
