You realize Xbox Live Enforcement Team members go on that game and look around? Also, 75% of people who play the game online are legit and don't mod. Plenty of people get reported and banned.

The xbl enforcement team comes on to lay with a person if and only if a certain number of complaints are filed against that person. Otherwise they will not waste their time on cod 5 if they cover all of xbl.
