The outcome would almost inevitively be that they fob you off with talk about their terms of service. Once you have spoken to someone, you can then write to trading stanards with the information that you obtained from MS (who you spoke to and what their response was). Or alternatively contact a 'no win no fee' (one who recover the costs from the other side if you win) and give them the information, they will then write to ms and ms will pay out.

Yea this sounds like a good idea but it can all fail depending on how you approach it. You can't get on the phone with a head of steam and start yelling or cursing at the person on the other line. Your best bet is to be the bigger man (or woman) and be patient and respectable. The more you respect their authority the more they will be willing to repect yours. Good Luck People!

Hang on, we are not taking them to a crown court here, we are talking about a small claims court where they will send 1 representative (if they even bother). Small claims court here is literally a room with you, the person you are claiming against and a judge. in 99 out of 100 cases the individual will win and a company will lose. The fact is that most companies would rather make an out of court settlement (whether that just be giving you a free xbox and a couple of games) than go to small claims court and even risk losing. It is bad press for them even if they win the case

I understand where you are coming from but luckily here in the free world we do not have the same corruption problems as the US has, and Europe seems to have much more admirable morals when it comes to fairness and equality. For example, America is pretty much the only country left in the world that operates slavery, criminals are put in jail for the sole reason of revenge rather than rehabilitation, meaning that people who have committed fairly small crimes or are not a danger to society are imprisoned for stupidly large amounts of time. While in prison for next to nothing they have a choice to either work for the equivilant of 20pence per day or go in to solitary confinement, obviously most choose to work and therefore the only reason that many goods can be produced in the US is due to slave labour, raking in billions of dollars every year for the prison service. There are even American products that are ONLY produced by prisoners, the American prison service have a monopoly on products due to the fact that they can force slave labour on it's own citizens in need of rehabilitation.

A bit long winded i know, but it is just an example of how the morals of senior officials of the US are lacking in the principles of much of the rest of the world and i am therfore not surprised that MS would pay off judges and jury's in the US. I can assure you that that would not be something they could consider doing here.

i need somone back up they will just laught at a 15 year old kid saying there going to sue them and hang up on me
also i phoned up and said i got banned for no reason and no email was sent to me about it so am very unhappy and i think the have mis treated me as a custemer who pays more than 100 Pounds a year to them,

Do you think for one minute MS would be banning people if they knew they were breaking UK law?

Wake up people, they are well within their rights to suspend any account which has broken their terms of use. It states, quite clearly, in the terms of use that by either facilitating or even taking part in a modded game mode that you are breaking the terms of use and can be suspended or even banned for good.
You agreed to those terms when you signed up for xbox live (whether you read them or not)so have absolutley no come back if suspended and i can guarantee that you will lose if the case ever did reach the small claims court, which by the way would then leave you with a hefty legal bill.
