It doesn't matter if it's illegal to be fair. Police aren't going to turn up at your house for a jailbroken iPod. You won't get found out.

Jailbreaking is not illegal neither is it frowned upon.
Apple have no rush to stop it because if the ipod is jailbroken the ipod's warranty ends

But, beware
if you are using for illegal downloads then as you could most likely guess, that is illegal
so is installous

If you own a Jailbroken ipod your chances of getting caught due to illegal downloads is maximized as well...
