Well as you no backwards compatibility is out and soon (December) black ops 1 is out but ok 360 I was banned so I'm wondering if I'll still be banned since there gonna be new servers?

You'll still be banned, backwards compatibility emulates a 360 so whatever you did on 360 will be on the xbox one.

Like Potion said, you will still be banned as it emulates the 360.

Id say so because the point of BC is to play with other people on the 360 consoles and its not like 360 is gonna get new servers.
