Someone already has the name I want 'Beaglez' he hasnt been online for over 2 years now.. Will xbox let me change it if I tell them or not?

Nope, all Gamertags are unique meaning two people or more cannot have the same gamertag.

Xbox support team also will not grant you the gamertag either even though he hasn't been online for over 2 years.
