okay, i have the yoda pro tool and i heard it has a ban bypass in it but do i need to have the tool loaded up before i get on the game to not get banned or what?

Yea, activate the bypass before you start it up

Sign out
Launch bo2 default_mp.xex
Open tool
Bypass
Wait 30 seconds
Click Xbox Live
Sign in
Play online
Profit?!??

To use the bypass:
Sign out of your account on the dashboard
Launch default_mp.xex
Enable the bypass (It's on the 'Other' tab of the tool)
Wait 10 seconds then sign into your account.
Wait for the version number in the top right corner to change.
Click Xbox Live again and enjoy.
