So after f*cking up my GTA V disc, while trying to 'hotswap' before the R* logo, I thought about getting my xbox slim flashed, and was wondering what is the risk on getting banned from xbox live?

The risk is very low. I have had a flashed xbox for 2-3 years now and I haven't been banned.

It depends, how much you mod on it, if you announce you have one , using it during a new update and/ or using it on a ban wave

It is not that risky as long as you burn your games the right way.
If you want to be extra safe check the games through ABGX then install them to your HDD.
