They can technically check the system NAND; which is believed to be how a lot of people got banned for playing Halo 4, even though they only played it offline before release as soon as they went on live after it was released they were banned. Halo 4 was also a microsoft 1st party game, while GTA5 is not. So it could go either way, I personally am going to play it on an offline only xbox.

The console flashed or not when you abgx a game you steal patch it microsoft cant tell the difference its basicly a legit copy of the game i am playing online with gta v im noy band so i couls care less

Just don't do it you will get caught and its not worth it
