I have a flashed xbox 360 and i want to play morrowind (original xbox) i was told i need to download the backwards compatibility update but i dont know if this will ban my xbox sense it is flashed.

No, that shouldn't do anything. Generally Dashboard updates are what you should worry about with a flashed xbox. Some people are safe and dont even download game updates from xbox itself, but rather from online. That's not necessary though.
