Thats a tough one, if they are kind they may offer replacement but there is always a chance they will blame you and you will walk away with a broken disc, If i was you i'd take a parent and make them vouch it was broke when you received it (thats if you are a child) other wise nothing you can do my friend.

you should of bought the warenty for it when it gets scratched that's what I did

There return policy says once you have opened it you can exchange it for the identical item within 30 days of purchase,so you should get a replacement copy if they have any extras.
