Yes you CAN get banned for burning/hotswap and it's not just for modded lobbys you can also play any game you burn to that disc... and some modded lobbys for older games can be made doing that method.

If you Stealth patch the game on abgx360 you should be ok online. ( most of the time )

1. why are you going to buy a jtag/rgh to run burnt discs? you can go online with jtags or rghs. a flashed xbox is what youre looking for
