Anyone know if they can Console ban / Ban all accounts on an xbox for CMR lobbies? because i share an xbox with my brother and i dont want to go and get his account banned also , i was planning on making a 2nd Account and trying it , anyone know if they can do that?

I highly doubt there will be console bans issued. Unless it gets like Mw2 where they weren't able to fix it and Microsoft had to take care of the problem. If it's under Activision's hands no one will get console banned. But if Microsoft takes over removing the modders, expect console bans.

Microsoft isn't taking action.
So, no to the profile/console bans from LIVE.
But Infinity Ward bans the persons account from their servers.

yea IW is on high alert with the bans right now so dont do it, And they can ban your other accounts as well.
