I've only seen one person that has been banned.
But you probably will have a less likely chance of ban if you unlink your account from callofduty elite.
Also if you dont jump 0 prestige 1 to 15th prestige 50 you have a high chance.

People are being banned now, but it will say you cannot connect to the servers. But yes, people are being banned.
