My brother crys to me to give him the new black ops map pack to I transfer content to his xbox then after a week later he gets console banned? Like really? my Brother is 8 years old doesnt know what he is doing soo why does he gett banned? can someone help?

Telling microsoft he is only 8 will only get you into more trouble. You have to be 18+ to not be restricted to a child account.
When you both created your accounts, you agreed to their ToS (Terms of Service) and in the ToS it mentions marketplace theft. And sharing the same purchased DLC between to SEPARATE xboxs fits right in with marketplace theft.
Microsoft could easily argue that regardless of his age he accepted the ToS. And that it is his fault for choosing not to actually read it.
