I can guarantee the game will get leaked out between when it goes Gold and the release date. But since the game hasn't gone gold yet. Its anyone's guess as to when we will see a leak. But a leak is extremely unlikely at the moment. Since games are now being published in a new format (XGD3) which can't be ripped/burned at this time. The only way you're going to get the game early is by 4 ways.
1. Find someone selling a copy on Ebay for 3x the Retail price.
2. Hook up with a local individual through Craigslist and work out a payment.
3. Become extremely friendly with your local retailers and they might sell you a copy under-the-table.
4. Get connections with someone in retail to grab a copy once a shippment arrives or take a copy and return it to the store before its release date (This would involve you working at that store )

Managed to grab 2 copes of Gears of War 3 on Sept 9th with Option 4. But I wouldn't recommend that option to anyone. Since if you get caught. You, sir, are royally F*** in more then one way.
