No. A JTAGGED console isn't illegal. A JTAG can simply be used for learning purposes and not for recreation or profit.
What some people do that is illegal though is the copying of ripped games to play with a JTAG. If you buy a copy of the game legit for your retail then copy it over to your JTAG then it is completely legal as you are legally allowed to keep one extra copy of a legitimately bought copy but not allowed to sell that copy or put it in the ownership of another person.
If you simply download an ISO off the internet then extract the game files and play it on your JTAG then it is illegal for a few reasons. One reason is that the person you downloaded it from has profitted. It doesn't matter if they actually profit with currency or they profit reputation wise, saying thanks, any way they profit/gain something at all then it is illegal.
Another reason why it is illegal to download a game the play it is because of the copyrighted game files published by high powerful companies which you do not want to mess with.

Using a JTAGed console is against Microsofts TOS which means they can ban you from xbox live on that console, which they do. The JTAG itself isn't illegal at all but some of it's uses are. (As in playing games you don't own)

Okay,I'm not going to pretend I read every reply in the thread,but I really wish people read the stickies in a section before asking questions.
I went into A LOT of detail to explain this in my Beginners Guide to Jtags and that section alone took me quite some time to think out,re-phrase and then type.
Short answer: No they are not illegal. They never have been and they never will be.
Long answer: There are many more factors,such as what you have on your Jtag/what you are using it for.
