You still have to have it in and working they said nothing about changing kinect. The only way of preventing it "Watching" you is to turn the camera off which for most people is effort so they will have to be "Watched"

First of all, the first (current) version of Kinect can not do that. It also cannot detect heart rate from a person. It doesn't need to always be on, and you can turn it around. What's it going to do, report you to the police? Just have some fun, turn it around and pretend you're all doing coke. Make sniffing noises for ages yelling that the coke is amazing, when the drug squad turn up, you'll all be drinking cola.

It will spy on you as much as the camera in your iphone and laptop spy on you. Why is everyone worried about the kinect? I'm sure if the government wanted to spy on you it would be through your phone, not watching kids in their underwear playing xbox.
