I think it's the same on all phones...
Settings>iCloud>Sign Out.

but i cant get to main screen and ask me for email and password and tryed to contract seller but wont contact me back so im guessing its stolen but still

Than yeah it's stolen, I don't think you can do much without without the persons information...

I think it's practically a paper-weight now.

Just restore the phone. Other than that you probably are out of luck.
