you could if about 5+ people reported you about it but i highly doubt that will happen as I've been modding for years and the majority of it was for trolling people

you wont get banned from hotswapping you but can with a flashed Xbox only if you get a dash update and that is when you go swap to a none flashed Xbox

You can get banned for either, depending on what you do with it. Flashing is more likely to get banned. Hotswapping/ISO modding is least likely to get banned; depending on whether you ISO mod a lot & abuse them.
