Define "caught". Caught as in your ISP sending you a letter for using too much bandwidth or caught as in legal issues? Either way, an nzb will take up bandwidth and either way is still 'illegal' because you're pirating copyrighted software. My ISP doesn't seem to care at all. I hog up all my bandwidth downloading loads of things and I'm fine. Been fine since 2005.
caught as in legal issues. i know it uses bandwidth, but a friend of mine uses a program (i forget what its called) but it basically makes it harder for him to get caught legally and from his ISP.
Basically the only way to not get "caught" is to slow down transfer speeds and you can do that in any torrent application. Your ISP (if they choose to do so) can view all your data that is being downloaded if they suspect you are downloading pirated material. That's why some people end up getting the nice cease and desist letter. Just lower your bandwidth consumption and you'll be fine.
