I have heard of some people doing this and banned for "Marketplace Theft".

Cathy R: The License transfer can only be done once every 120 days, If your friends download it to your Xbox, they will not be able to download it back to their console for 120 days
Jack: Yes, but if multiple friends do this on my console, can it result in a ban on my profile and/or Xbox?
Cathy R: No, the license transfer is tied to the gamertag and the console, so you would need to download the profile and the games, but you should not get banned for this.
Cathy R: Jack, I am not able to get into that account, would it be ok to send you a link so you can sign into that account?
Jack: Sure

No if your going to license transfer your stuff or your letting your friends have some your allowed, but only every 120 days so be careful!
