Hey TheTechGame,

Recently I was Console Banned for Unknown Purposes as I am 100% sure I didn't violate the ToS. I am revising my post regarding console banning to make it more accurate. By the way I know you sign up and agree to the ToS but still, who reads them and second of all, they do mention that a dispute can be taken to court in this text, taken from the terms of service found on the xbox website, [ Register or Signin to view external links. ]

To begin a console ban reads the message, This console has been banned for violations of the Terms of Use. To protect the Xbox LIVE service and its members, Microsoft does not provide details about console bans. There is no recourse for Terms of Use violations..

The sixth amendment to the constitution states in kid terms, If you're arrested, you have a right to have your trial pretty soon, and the government can't keep you in jail without trying you. The trial has to be public, so everyone knows what is happening.

Microsoft/Xbox is removing this right from you. Think about it. You aren't able to appeal your Ban. You and the Public cannot find out why you're banned because of security purposes (If you're confused this deals with the Trial has to be public part).

If anyone reading this, and Yes, I am sure there are some have no idea as to what a trial is you can find out here ; A formal examination of evidence by a judge, typically before a jury, in order to decide guilt in a case of criminal or civil proceedings. PLEASE NOTE PROOF MUST BE PRESENTED TO BOTH PARTIES

The problem with console bans is that Microsoft/Xbox; specifically the XBLPET (Xbox Live Policy Enforcement Team), is holding back proof as to why you were banned. If Microsoft/XBox wanted to ban every user from XBL they can, and they can be banned without proof.

In summary I am writing this to show how the Xbox ToS/Console Ban system is going against your right's and that us a community need to stand up to them and show them that a change in the system is needed. They need to allow; a) Appealing the Ban; b) Show Proof.

Please thank the topic and/or post here stating weather you agree or not.

By the Way Mod's I am in no way, shape, or form trying to start a flame war. I am also backing up my statements with information I researched. If their are any issues regarding this Mod's or Admins, please contact me and allow me to edit the topic instead of closing it and taking action against my account.

Eh, you're wrong though I have a 4.2 GPA and am pretty sure that a majority of people ignore the terms of service.

So basically you are saying every time someone is banned we should take microsoft to court? I wouldn't waste my time on them when i can go buy a ps3 instead

A ToS has nothing to do with the law. They provide a private service. If you void their ToS, they ban you and there isn't anything you can do about it.

EDIT:
And concerning taking them to court over it, that's only if you are wrongfully banned.

Good point but the truth is thats the only way microsoft can make money by making retarded as choices by ripping of people
