This would be awesome to see but the likely hood of it happening is slim. The "Xbox" brand is still very much in use by Microsoft, anyone trying to replicate Xbox Live would surly run into legal problems by them. What I can see as a possibility is someone making a app you can launch from a modded xbox to emulate live and connect to a third party service. Sorta like how xlink kai or XBSlink except it would cut out the need of having a computer.

Some guys did something similarly with the Dream Cast. I'm not too sure how it fully worked, but I know that they emulated a dial-up connection with this dongle you would plug into the connection port on the Dream Cast.

I think I'd rather have a more modern application similar to Xlink kai or even XBC Xbox Connect (which what I used) - Yeah you need a PC but I never had any real issues. Plus since Xbox is backwards compatible you can play on your 360 and it doesn't matter if it's banned or not. Only problem I did have was that on XBConnect most of the Halo 2 players were from some portion of South America which made the game always lag. Every now and again I'd find an American and just play with them.

An application like those two and a ton of populated servers would be awesome.
