I want to transfer my OS(Windows 8), which only has an upgrade license, so I can't do a clean install, to a new SSD, wold it be safe to clone only the OS to the SSD then re-install it so 4K alignment is correct? Or is there some other way than cloning?

Can you not simply just use the migration software that came with the SSD (of course if there is one)

Try using this, it will move your partition from your HDD to your SSD and apparently works on Windows 8
