I cant see why he should be banned? IF he has a legit copy, he should be able to do what he likes. Microsoft shouldn't punish people for purchasing it early. The retailer should be the one getting punished.

LOL, it doesn't matter if you play multiplayer, he's playing Halo 4 on XBOX LIVE before the game came out. Microsoft will find that and instantly console ban him, say bye to your friend, you won't see him unless he buys a new xbox...(or if you know him in real life)
