Epic to continue pursuing its lawsuit against 14-year-old cheater

Epic Games will continue to peruse its lawsuit against a 14-year-old boy for cheating in Fortnite.

According to the lawsuit filed by Epic Games, the 14-year-old “actively promotes, distributes, and induces others to use cheat software”.

The teenager is one of the Fortnite cheaters Epic Games filed a lawsuit against back in October. The developer filed complaints with a North Carolina federal court citing violation of the game’s terms of service and EULA. The circumvention of technological measures was also cited in the filing.

A letter written to the Eastern District court of North Carolina by the defendant’s mother in November was “interpreted by the judge as a motion to dismiss Epic’s claims,” according to GI.biz.

In the letter, she stated the game’s ToS requires parental consent for minors to play, consent she claimed was not provided. Furthermore, she stated Epic Games would be unable to prove cheating in a free-to-play game could result in the loss of profits.

“It is my belief that due to their lack of ability to curve cheat codes and others from modifying their game, they are using a 14-year-old child as a scapegoat to make an example of him,” she wrote. The letter adds the company also illegally released the name of her underage son.

Epic followed up this week (thanks, TorrentFreak) with a new filing on April 23, arguing many points made by the mother were incorrect; therefore, it is asking her motion for dismissal to be denied, and is seeking a default judgment against the 14 year-old.

No matter what the age, cheating is cheating, cant be one rule for one and another for a kid. Of course the parents will have to pay out lol.

Petite While this is a scare tactic undoubtedly I'd love to see how much epic has spent on this case and how much money they're trying to say the kid stole.

Also ever since this cased surfaced this kids mom has been a badass sounding 3x more logical than epic.

This is a million dollar AAA dev team, literally suing and underage kid for modding/scripting.

I hope the kid wins the case personally cause it'll make epic look like a joke.

I love the game and love epic and everything about it but I'm sorry continually trying to ruin a kids life over a game is just a huge dick move.

This is quite possibly the most illogical response I've heard in response to cheating. So you're saying, it's okay to cheat if you're underage, your mom should lie to the court for you, Epic should "just hire more people", and companies intellectual properties should be disregarded.

This kid should be sued and I hope he loses, no one like a cheater except a cheater.


For one just chill my man we're commenting about a case that doesn't effect us personally at all on a website that in reality doesn't matter to people outside of us. I'm not trying to offend you and never did I say the kids mom should lie for him nor did I say cheaters should get away with it. Take a chill pill dude lol.

I'm not going to get into this too much again but as been said before previously by myself and Petite they haven't actually lost anything this case has been going for almost what a year now over a 14 year old kid.... honestly his day in court would have been enough to scare him in the first place.. The kid hasn't even started his life yet and he's dealing with this over a cheating in a game... Which many of the previous generation got away with....

I feel like they're doing this for more of a scare tactic to show that anyone can get in trouble if they cheat in their games.

Kind of smart tbh, games not gonna lose any type of revenue, still gonna be relevant, and modders are gonna try to stray away from the game.

First of all who actually reads ToS on anything, and when it comes down to a 14 year old they're not going to do it either, they don't think of it like I may get in trouble for this, that's bs. If you think about it we're all older on here so we act like we know it all but we all know if we was 14 year again we'd probably do the same thing, then we'd be the people being insulted " oh you should get full punishment " but we'd not want that at the age of 14, at the age of 14 we're just trying to figure stuff out and have fun lol.
