Wondering why the big Xbox modding trial has been dismissed already? Well the major answer appears to lie within the fact that the defendant never installed pirated software on modified Xboxes. Earlier on in arguments, the prosecution accused the defendant of installing pirated software to verify his modding skills. However, in a witness report it was NEVER mentioned that the modder actually inserted a pirated game into the console. Interesting stuff. If he had inserted a pirated disc infront of the undercover witness ,he may well be looking at 10 years of jail. Now he's looking at zero!

Remember this was merely a badly exercised plot to run this through a court had they been on the ball, this would end differently. All modders should do so in their own home, in which case it would be illegal to record on your property in most countries without your permission. MODDERS BEWARE!
