im not an Xbox gamer, just trying to work out if one of the kids has been playing it early in the morning so hope someone can help
Does it search for updates during the night when it's turned off or does it need to be turned on for the that?
Is there anyway to check when the console was last played? Like checking screen time on an iPhone ,thank you

Check "Power & Start-up" in settings
If the setting "Instant-on" is enabled... It will update overnight.

the only way to check if the account has been logged in anytime recently, is through the Microsoft Security Tab < although this would require you to login with a password I think >

agree with the guy above though ^ but then again I was a kid and played even when I was told not to, good old child hood days.

Although if it really is that big of a deal for you, then you can just add a partner account and I'm pretty sure you can limit hours etc.

Yes, you can allow your Xbox to automatically update games when its in rest mode. You can turn this off in the settings.

Screen time
For a breakdown of your child's overall time spent on each of their devices, the Screen time section indicates when and for how long your child used their devices throughout the week. You'll see a list of how much time they spent on their devices overall by each day, and also how much time they spent on each device during the entire week.

Simply set up a family group and add your kid(s), adjust the settings depending on how strict you are too. You can see what games they play, how long they played allowing you to use your parent instincts to add up the numbers and see if their slipping in some game time at night or in the morning like you said.
