Ok long story short I've been working the same job for 3 (almost 4) years. I wasn't looking for a new job, but an opportunity has came up that I cannot refuse. In my contract, it states that I have to give 28 days notice before I leave, however this new job wants me starting Monday. I called my employer as soon as I knew and now he's refusing to pay my wages as he states in my contract that he can take my wages if I don't give notice?

Now I currently do not have my contract, as I'm waiting for my Dad to get back to me with it. However, is this something he can do? I always thought they can deduct your wages, but not take it all, surely?

I understand this is mainly a gaming forum, but if anyone has any input or answers, PLEASE let me know.

What state do you live in, most states are at will states and you don't need to give a notice or a reason why you're leaving.


We don't know the full story, since we don't know 100% about the contract you signed. Any amount of work you have performed should be paid out regardless of the contract, as I believe that would open them up to unpaid wage lawsuits.

I actually live in the UK, England to be exact.

Yeah I'm still waiting on him to give me a call with the contract. I'm in a dilemma because I'm supposed to be in work tomorrow, but if it's in my contact and he can actually do that, I'll theoretically be working for free.

I'm so stressed right now it's unreal.

Thank you for the help so far, I don't know who I can go to for help.. that's why I'm posting it on here.

its a tough one to answer in a few short sentences,are you paid monthly or weekly,if it states in your contract that you signed that you have to give 28 days notice then thats what you have to do,however to get around this you can go sick(work at new place while your sick from original job) until pay day,once you get paid you can just quit there and then,you wont lose any money but they will probably refuse to give a reference if your bothered or need one,if you want to do things properly then hand in 28 days notice,if you have holiday owing then use that as your notice,these are your only choices,personally if the job is what you want to do,i would go sick until payday,once paid then id quit,your choice though
