If you have a ffl then you have to do background checks. So places like Walmart or Academy, the big companies have to do background checks. But for private sales, there is no background check required. Last time I checked, you are supposed to make sure that they over the legal age, they are a resident of the state, and you can not knowingly sale to a felon. Other than that private gun sales are good to go. 002 will probably have more to say about this. But that is what I know.

EDIT: And I am pretty sure that you need a FFL if your purpose of being at the gun show is to sell guns. Some gun shows have people who sell survival gear and what not, then they would not need a FFL, because they are not selling firearms.

But if it is just your hobby and you are a collecter, then you do not need a FFL, but if your intentions are to buy and sell guns like a dealer, then you need a FFL.

So really there is no gun show loop hole. If you are selling guns then you need to have a FFL.

An FFL is a Federal Firearms License. The way it works is The unlicensed individual (you, me, people at gun shows, etc.) transfers the firearm to a Federal Firearms Licensee (FFL) located in the State of the person receiving the firearm. The FFL will transfer the firearm to the unlicensed out-of-State person. The FFL will be responsible for lawfully transferring the firearm.

It is a federal crime to buy / sell a gun without an FFL. Remember that federal law supersedes state law meaning that no matter the states law, everything falls under federal law so it is illegal everywhere to purchase a firearm without an FFL transfer. The only way around this is if it classifies as an antique firearm, or apply for a C&R FFL through the BATFE. A C&R eligible weapon is a weapon that is 50 years or older or else otherwise designated as shown in the C&R eligibility book provided by the BATFE to C&R license holders.

All people at gun shows selling firearms are supposed to be a registered FFL, any of them that are not are committing a federal crime, and so are you if you buy from them.
