This is really two different topics but I'd rather just keep them both here. The other day I was at the laundry mat when I watched a car hit an SUV and flip it. The car had very little damage but the SUV of course wasn't so lucky. In the car there was a girl in her teens, and in the SUV was a mom and her 3 sons (all between probably 3 and 10).

First off is the know your limits issue on this. My boss and I were the first on scene getting people out of the SUV, and other people came out of nearby stores to help. Two of the kids were properly belted in car seats (the other kid was properly belted as well, just old enough to not have a car seat). One of the guys that came to help tried to yank one of the kids out of the car seat and was unsuccessful so he's getting hit knife out and trying to cut the seat belt. I pushed him aside because I already seen that kid was going to fall and possibly get stabbed by this moron. If you don't know how to get a kid out of a car seat, GET OUT OF THE WAY! Let people know you can't get him and someone else will get the child unbuckled. Someone else was able to unbuckle the kid and I took him out of the SUV.

Next up is keep your car clean. Of course at a wreck (especially a roll over) there will be tons of crap everywhere. This ladies car had not garbage but miscellaneous crap that we all have in her car and she just didn't have them stored properly. There was something large and heavy in the car because it smashed one of the windows, cracked a bunch of plastic trim and looked like it had hit one of the car seats. I know things will be broke in a roll over, but it looks like a damn brick was free floating in the car and could've easily killed any one of them in that SUV.

The SUV's airbags all deployed and everyone was safe, the cars airbags did not deploy and the girl was VERY distraught but everyone is safe and walked away without need to go in an aid car.

I would have ticketed her for it.

During a rollover, loose items can cause fatal injuries. I have seen it before.\

Glad to see everyone was okay.

Is there a law to say that you need to secure any loose items? Apart from it being common sense and the possibility of causing harm of course, just curious.

Or let's say, you're performing a regular traffic stop and you see a few loose items in the car, what would you do?

If the vehicle in question has an extreme amount of garbage or items around, you can by law give her a citation.

Better take your trash out before you take your car for a spin because its illegal to store garbage in your vehicle. This traffic ordinance is more like a health-code violation because towns don't want drivers harboring rats in their vehicles. This violation could cost you $500 in fines or 30 days in jail

While it's very rare anyone can get a ticket for it, it's still a legal citation.

So to answer your question, if i stopped someone who had lots of trash or loose items in the car. Would i ticket them for it? Probably not.

If they were involved in a MVA and loose items caused injury to occupants. I would then ticket them, yes.
